ClassGRIT is an educational platform where teachers can access educational games and resources for use with their classes and students.

These Terms of Use (“TOU”) contained herein on this webpage, shall govern your use of this website, including all pages within this website (collectively referred to herein below as this “Website”). Any use of the Website is subject to the following Terms of Use, as well as to ClassGRIT's Privacy Policy. By using this Website, you expressly accept all terms and conditions contained herein in full. You must not use this Website, if you have any objection to any of these Website Terms of Use.

2. ELIGIBILITY

The Website is for teachers ages 18 and up. By using the Website, you guarantee that: (a) all registration information you submit is truthful and accurate and (b) you will maintain the accuracy of such information.

Children can play the games on this Website that their teachers share with them via link, but cannot log in to ClassGRIT or directly access the content on the Website on their own.

3. ACCOUNTS

Access to the Website may require the Teacher registering an account with ClassGRIT (“Account”). In order to access an Account, you may be required to obtain a user ID, password, or a login access code. You are responsible for maintaining the security and confidentiality of your account and data, and you are fully responsible for all activities that occur under the account. You are prohibited from sharing account or login information. You must immediately notify ClassGRIT of any unauthorized uses of your account or any other breaches of security.

4. SUBSCRIPTIONS

Subscriptions to the Website can be purchased from the third-party site Teachers Pay Teachers. Your subscription grants you limited, revocable, non-transferrable access to the Service. By agreeing to this TOU you hereby also agree to comply with all third-party contractual and/or legal requirements of any TPT Subscription you purchase.

5. AUTHORIZED USE

The ClassGRIT Service is intended to be educational. If you create question sets (“Content”), you are entirely responsible for the substance of that Content. You are also entirely responsible for ensuring that you are lawfully entitled to use any information and material. ClassGRIT does not assume any responsibility for damage caused by your errors, omissions, or negligence with respect to Content you post. You are expressly and emphatically restricted from all of the following:

  1. sharing your account information or logging in/accessing another user’s account
  2. making any attempts to gain unauthorized access to the Website
  3. using bots, spiders, viruses, worms, or any automated system to access the Website
  4. changing or attempting to circumvent the security aspects of the Website
  5. selling, sublicensing and/or otherwise commercializing any Website material;
  6. using this Website in any way that is, or may be, damaging to this Website;
  7. using this Website in any way that impacts user access to this Website;
  8. using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or to any person or business entity;
  9. engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website;
  10. using this Website to engage in any advertising or marketing;
  11. publicly posting Content that violates privacy rights, publicity rights, copyrights, trademark rights, contract rights, or any other rights of any person
  12. posting Content that is libelous, unlawful, or in violation of any person’s or group’s rights
  13. posting Content that is offensive and promotes racism, bigotry, hatred, or physical harm against any class or individual
  14. posting Content that contains anything sexually suggestive or violent in nature

as determined by ClassGRIT in our sole and absolute discretion.

6. YOUR CONTENT

Your Content must be your own and must not be infringing on the proprietary rights, including but not limited to the copyright, trademark, or terms of use of any third party.

All Content posted on the Website belongs to ClassGRIT and will remain on the Website at the discretion of ClassGRIT. While your content may remain on ClassGRIT after your subscription has ended, your access to your Content will end at the conclusion of your subscription period if you do not choose to renew your subscription.

ClassGRIT reserves the right to remove any of Your Content from this Website at any time, and for any reason, without notice.

7. COPYRIGHT INFRINGEMENT AND DMCA POLICY

If you believe that material on the website violates your copyright, you are encouraged to notify ClassGRIT by email at help@classgrit.com. ClassGRIT will respond to all such notices, including as appropriate by removing the infringing material.

8. SUSPENSION & TERMINATION

ClassGRIT may suspend or terminate access to the Service and/or your Account, without notice or compensation to you, at any time for any reason. ClassGRIT has sole discretion to lift a suspension or reverse a termination. Your access to the Service and/or your Account is automatically terminated upon the earliest of the date: (a) you or ClassGRIT terminates access to your Account; or (b) of your non-compliance with the TOU.

9. LIMITATION OF LIABILITY

In no event shall ClassGRIT, nor any of its administrators, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, and ClassGRIT and its administrators shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

10. VARIATION OF TERMS

ClassGRIT is permitted to revise these TOU at any time as it sees fit, and by using this Website you are expected to review the TOU on a regular basis to ensure you understand all terms and conditions governing use of this Website.

11. ENTIRE AGREEMENT

These TOU, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between ClassGRIT and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

12. GOVERNING LAW & JURISDICTION

These TOU will be governed by and construed in accordance with the laws of the State of Pennsylvania, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Pennsylvania for the resolution of any disputes.
